Shawnee County District attorney Chad Taylor announces that his office will not appeal the Kansas Supreme Court’s reversal of State of Kansas v. Phillip Cheatham.
“After exhaustive research, and collaboration with numerous prosecution partners, this office will not ask the United States Supreme Court to review this matter. While we are extremely disappointed with the conclusions reached by the Kansas Supreme Court in this case, our review of the Court’s opinion as well as other relevant case law from across the nation, both federal and State, leads to this decision.”
“It is our position that in order to protect and preserve the rights of the victims, their families, and the public in general, that a complete and thorough review of appellate options was absolutely necessary. Unfortunately, the incredibly limited number of cases the United States Supreme Court can accept for review, together with the unique facts and circumstances of this case render an appeal in this matter ill-advised.”
“It is our intent at this time to move forward with a retrial of this case and this office stands ready to bring to bear whatever resources are necessary to ensure that Justice is done.”
