TOPEKA, Kan. (KSNT) The Topeka Police Department was dispatched around 1Tuesday morning to a vacant building at 2121 SW Belle.
The property owner stated he was inside the building with two suspects who had broken into the business. He told police he was armed with a firearm.
Police say contact was lost with the man as officers arrived. As the officers were assessing how to gain entry, one of the suspects tried to run out the rear of the building causing the owner to fire his weapon. The suspect was taken into custody as he exited the building.
The second suspect surrendered to the police.
Both suspects and the man who fired the gun were taken to the LEC for questioning.
One of the suspects, 36 year old Matthew Schuetz has been booked into jail for aggravated burglary, attempted theft and criminal damage.
The victim of this crime has been identified as Kent Lindemuth of Topeka according to police.
