TOPEKA (KSNT) – The Shawnee County District Attorney says he will not file charges against Topeka Police Captain Darin Scott.
D.A. Chad Taylor ended speculation of Scott’s future in a letter to Shawnee County Sheriff Herman Jones Tuesday.
Scott has been on paid administrative leave since October 7th while an investigation was conducted by the Sheriff’s office and later referred to the county attorney’s office for review.
The City of Topeka never specified why the investigation was launched, referring all comment to the Sheriff’s office.
In the letter to Jones, Taylor concludes that after review the reports submitted by the Sheriff’s office “…there is insufficient evidence to meet the charging standard of ‘beyond a reasonable doubt.’ If you obtain additional evidence you would like us to review, please send the evidence to my office along with a charging affidavit for further consideration. Absent that, my office now considers the criminal investigation into this matter closed.”
According to city spokesperson Suzie Gilbert, Scott has been reinstated at his current rank with the department with full law enforcement powers. “The matter has been resolved,” she tells Kansas First News.
