City of Topeka and Jayhawk Racing ask Kansas court to let Heartland Park deal go through

TOPEKA (KSNT) – In the latest move over the City of Topeka’s plans to buy the Heartland Park Race Track, the City of Topeka and Jayhawk Racing on Monday asked the Kansas Court of Appeals to let the deal go through.

In similar briefs filed Monday with the appeals court, both maintain a district court ruling the petitions are invalid should be upheld. They ask the court to lift a temporary stay which bars the City from issuing $5 million in STAR bonds to improve the area around the race track.

Those behind the petition want that ruling overturned, and have asked the Appeals Court to let the petitions stand in order to get a public vote on the proposal.

The Appeals Court must now decide whether to simply rule on the legal briefs or hold a hearing on the case.
