TOPEKA (KSNT) – Emergency crews responded to a 2 vehicle fatal crash at 6th and Gage in Topeka around noon Thursday following a short pursuit.
At noon a Kansas Highway Patrol trooper attempted a traffic stop on Gage Boulevard at I-70 on a Chevrolet Impala after observing a traffic violation. A minute later the driver of the Impala failed to stop and after a brief pursuit, struck a gray Toyota passenger car traveling westbound on 6th Avenue at the intersection of Gage Boulevard.
KHP reports a passenger in the gray vehicle was killed and the driver was transported to a Topeka hospital in critical condition. KHP says there were three occupants in the suspect’s vehicle, the driver and a baby in the back seat were taken to a local hospital to be checked out with minor injuries. KHP says Shawnee County District Attorney Chad Taylor was notified of the incident and responded to the scene.
The crash closed down the intersection of 6th and Gage and the ramps of I-70 & Gage for about 4 hours as crews worked the scene.
Marcos Adan Cruz Jr., 20, was driving the Impala that was fleeing from troopers. He was not wearing a seat belt and was taken to Stormont-Vail with injuries.
There were two passengers in the car with Cruz Jr.; a 21-year-old man, who was injured and not wearing a seat belt, and an 8-month-old boy. The infant, who was in a proper car seat, was “possibly injured” and was taken to Stormont-Vail Medical Center.
UPDATE: Jail records show Cruz was booked into jail at 9:21 Thursday night on 12 counts including murder in the first degree in the commission of a felony, aggravated endangering a child in a reckless situation and fleeing or attempting to elude officers.
Everyone in the Impala was from Topeka.
Driving the Toyota Camry was Jerry L. Griggs, 73, of Topeka. His injuries were severe enough that he was not able to move himself from the scene without assistance. He was taken to Stormont-Vail Medical Center and it is unknown whether he was wearing a seat belt.
In the car with Griggs was Edward Greene, a 69-year-old from Tecumseh, who was killed in the crash. It is unknown whether he was wearing a seat belt.
Earlier this month a 34-year-old Topeka woman was killed in a crash following a Topeka Police pursuit at 6th and Topeka Blvd. The suspect in that incident remains in jail on a $1 million bond and is facing a first degree murder charge.
