TOPEKA, Kan. (KSNT) – Topeka man convicted and sentenced to life in prison had his appeal heard Thursday before the Kansas Supreme Court.
Billy Davis Jr. was sentenced to prison for the 2012 rape and murder of 8-year old Ahliyah Irvin.
She was taken from her apartment, raped and then stuffed into a clothes dryer.
Davis is appealing on several points including insufficient evidence to support a conviction of pre-meditated intentional murder.
Also Davis’ defense attorney claims he never intended to kill the little girl.
